APPLICABILITY OF TERMS AND CONDITIONS.

2. PURCHASE ORDER.

 

Receipt by Cosmetics-beautyshop.com of an order form in any form, title or denomination whatsoever (an "order form") from the Customer shall constitute recognition and acceptance by the Customer of these General Conditions. Any purchase order submitted through the standard order form on this website constitutes an offer to Cosmetics-beautyshop.com to purchase products. References to “order form” in this document mean any document other than the General Conditions negotiated or executed by Cosmetics-beautyshop.com and the Customer for the purchase and sale of Products and/or services.

 

3. DUTIES AND TAXES WORLDWIDE (Except the 27 countries of the European Union).

 

Unless Cosmetics-beautyshop.com and the customer agree otherwise in writing, delivery of all products shall be an EXW trade term for Cosmetics-beautyshop.com products.

You may be charged customs duties and taxes for an item purchased online because:

4. ACCEPTANCE OF ORDERS.

6. PAYMENT.

7. DELIVERY within the EU.

 

Unless Cosmetics-beautyShop.com and the customer agree otherwise in writing, delivery of all products shall be an EXW trade term for Cosmetics-beautyShop.com products. Delivery times are estimated between 1 and 5 days throughout Europe. Cosmetics-beautyShop.com will not be liable for damages resulting from late delivery for any reason. Delivery to the customer's site constitutes delivery to the customer, whether the customer or his agent is on site at the time of delivery or signs an acknowledgment of receipt. Any claim for shortage or erroneous delivery must be made in writing within five (5) days of delivery, failing which such claims will be deemed waived by the Customer.

 

8. WORLDWIDE DELIVERY CONDITIONS.

 

Unless Cosmetics-beautyShop.com and the Customer agree otherwise in writing, delivery of all Products is governed by the EXW Terms of Trade for Cosmetics-beautyShop.com Products. Delivery times are estimated between 1 and 10 working days under WORLDWIDE DELIVERY CONDITIONS. Cosmetics-beautyShop.com will not be liable for damages resulting from late delivery for any reason. Delivery to the customer's site constitutes delivery to the customer, whether the customer or his agent is on site at the time of delivery or signs an acknowledgment of receipt. Any claim for shortage or erroneous delivery must be made in writing within five (5) days of delivery, failing which such claims will be deemed waived by the Customer.

WORLDWIDE SHIPPING TERMS include delivery terms: Goods are delivered when the goods enter the recipient's country and not when the recipient has paid taxes and duties or delivered to the recipient's address.

No delay in delivery can be applied to Cosmetics-beautyShop.com due to the duties and taxes of the country, or the delay in payment of these taxes and duties.

 

9.EXW – Ex-works conditions

 

The seller makes the goods available at his premises. EXW means that a buyer takes the risk of bringing the goods to their final destination. The buyer arranges for the collection of the freight from the ship's site designated by the supplier, owns the freight in transit and is responsible for the customs clearance of the goods. The buyer is also responsible for completing all export documents, taxes and duties.

 

10. INSTALLATION.

11. OWNERSHIP AND RISK OF LOSS.

 

Ownership of the products passes to the customer when Cosmetics-beautyShop.com receives full payment of all sums due for the products, including taxes and delivery charges. The risk is transferred to the Customer upon delivery.

 

12. WARRANTIES.

 

Cosmetics-beautyShop.com only warrants its title to the Products. All other warranties are those of the manufacturer. Cosmetics-beautyShop.com disclaims all express and implied warranties of merchantability or fitness for a particular purpose. Cosmetics-beautyShop.com assigns to the Customer any warranty provided by its supplier and by the manufacturer. The Buyer waives any right of legal action against Cosmetics-beautyShop.com for damages caused by the Products.

 

13. RETURNS AND REFUNDS.

 

If you are not 100% satisfied with your purchase, simply return it within 14 days and we will refund the full cost of the item less shipping costs

Return costs are 100% the responsibility of the buyer.

Any product you return must be in the same condition that you received it and in the original packaging. Please keep the receipt.

Any product damaged or not received in its original packaging will not be refunded.

 

14. LIMITATION OF LIABILITY.

15. APPLICABLE LAW.

 

These terms and conditions and any agreement for the sale of products or for the provision of related services shall be interpreted in accordance with the laws of the Republic of Poland.

 

16. EXCLUSIVE JURISDICTION.

 

All disputes arising out of or relating to a purchase order shall be resolved exclusively by Polish courts.
